Terms and Conditions

Welcome to Stimulus Consulting Pvt. Ltd. The terms and conditions contained herein along with the Privacy Policy form an Agreement regulating our relationship with regard to the use of Stimulus Consulting Shopping by you. You are advised to read this Agreement carefully. If you are not agreeable to any terms and conditions, you should not use this service. You can use the Stimulus Consulting Shopping Services if you are agreeable to all the terms and conditions of this Agreement in their entirety. If you accept this agreement, it will be a legally binding agreement between you and Stimulus Consulting Pvt. Ltd

Definitions:

"Agreement" means the terms and conditions as detailed herein including all schedules, appendices, annexures, Privacy Policy, and will include the references to this Agreement as amended, novated, supplemented, varied or replaced from time to time.

"Vendor"/ "Seller"/ "Affiliates" shall mean the person or any legal entity who offers for sale, sells the products on the stimulusconsulting.com website.

"User" means and includes any Customer / Buyer / You (the person or any legal entity) who accept the offer for sale of the Vendor / Seller, through "stimulusconsulting shopping" by placing an order on the website.

"Product(s)" connotes the goods, services promoted / displayed on the Site and offered for any use / sale. "Customer" / "Buyer" shall mean the person or any legal entity who accepts the offer for sale on Stimulus Consulting Pvt. Ltd. Shopping by placing an order for and or purchases any products offered for sale on stimulusconsulting.com Shopping.

The agreement between you and Stimulus Consulting Pvt. Ltd., here in after referred to as SCPL shall be subject to the following terms and conditions:

  1. The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian.
  2. These terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the Shopping services of SCPL you agree to be bound by the Terms and Conditions.
  3. All prices, unless indicated otherwise are in Indian Rupees.
  4. All prices and availability of products are subject to change without prior notice at the sole discretion of Stimulus Consulting Pvt. Ltd.
  5. SCPL reserves the right to refuse to service or cancel any order placed for a product that is listed at an incorrect price. This shall be regardless of whether the order has been confirmed and/or payment levied. In the event the payment has been processed by SCPL the amount shall be refunded by way of credit to your account and duly notified to you by email.
  6. In a credit card transaction, you must use your own credit card. SCPL will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user.
  7. In the event that a non-delivery occurs on account of incorrect information supplied by you (i.e. wrong name or address) any extra cost incurred by SCPL for redelivery shall be claimed from you.
  8. Shipment/delivery time of order processing starts from the day we receive the payment confirmed against the order placed with SCPL. The Shipment / Delivery time is an approximate time mentioned against each product. SCPL shall not be liable for any delay / non-delivery of purchased goods due to reason such as flood, fire, wars, acts of God or any cause that is beyond the control of SCPL
  9. The user expressly agrees that the use of service(s) provided by SCPL is at the user's sole risk. The service(s) is provided on an "as is" basis without warranties of any kind, whether express or implied. SCPL , its affiliates, employees, agents, consultants, contracted companies make no warranties of any kind, whether expressed or implied, for the service it is providing or as to the results that may be obtained from use of the service, or as to the accuracy, reliability or content of any information, service, or merchandise provided through this service. SCPL does not represent or warrant to maintain the confidentiality of information; although SCPL's current practice is to utilize reasonable efforts to maintain such confidentiality.
  10. Presently, the service(s) of SCPL Shopping are being offered free. However, SCPL reserves the right to charge a fee for any or such facilities.
  11. The User agrees to use the services provided by SCPL, its affiliates, consultants and contracted companies, for lawful purposes only.
  12. The User agrees to provide authentic and true information. SCPL reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly), SCPL has the right in its sole discretion to reject the registration and debar the User from using the Services of SCPL Shopping, and / or other affiliated websites without prior intimation whatsoever.
  13. Partial / damage delivery of product needs to be reported within 10 days of receipt of the product.
  14. Delivery of orders would be done address specific and not person specific.
  15. This site is created and controlled by SCPL in Bangalore, India; as such the laws of India shall apply; courts in Bangalore shall have jurisdiction in respect of all the terms, conditions and disclaimers. SCPL reserves the right to make changes to the site and the terms, conditions and disclaimers.
